Terms of Service Details

— Heads Up

→ TODO: Caleb to finalize Terms of Service copy with legal review. The structure below is a reasonable plain-English starting point pending review.

— Section 01

Acceptance of Terms

By using this site, you agree to these terms. If you don't agree, that's okay, but please don't use the site. These terms apply to everyone who visits, browses, or interacts with anything published here.

— Section 02

Use of the Site

You're welcome to use this site to learn about us, read our content, fill out our forms, and reach out. You agree not to use it to do anything illegal, harmful, or disruptive. That includes attempting to break our security, scrape content at scale without permission, or impersonate someone else.

We reserve the right to limit or block access if someone is using the site in a way that hurts other visitors or our business.

— Section 03

Intellectual Property

Everything on this site, including the text, design, logos, photos, and underlying code, belongs to Five One Nine Marketing or our licensors. You're welcome to view it and share links to it. You can't republish, sell, or claim it as your own without our written permission. If you'd like to quote, reference, or cite our work, just ask. We're generally happy to say yes.

— Section 04

User Content

If you submit content to us through a form, comment, message, or any other channel, you keep ownership of what you sent. You give us permission to use it for the purpose it was shared (for example, to respond to your inquiry or evaluate working together). You're responsible for making sure anything you send is yours to share and doesn't infringe on someone else's rights.

— Section 05

Engagement Agreements

→ Engagement terms with Five One Nine Marketing are governed by separate signed agreements, not these site terms. If you become a client, the scope of work, deliverables, fees, and any other commitments live in your engagement contract. Nothing on this site creates a service relationship by itself.

— Section 06

Disclaimers

We do our best to keep this site accurate and useful. The information we share is for general educational purposes. It isn't a guarantee of specific results, and it isn't a substitute for advice tailored to your business.

The site is provided "as is." We don't promise it will be available 24/7, free of errors, or compatible with every device. We work to make it reliable, but we can't guarantee perfection.

— Section 07

Limitation of Liability

To the fullest extent allowed by law, Five One Nine Marketing isn't liable for indirect, incidental, or consequential damages tied to your use of the site. If something we provide causes a problem, our total liability is limited to the amount you paid us (if any) in connection with the use of the site or service in question. Some places don't allow this kind of limitation, so it may not apply to you.

— Section 08

Indemnification

If your use of the site causes harm to someone else, or violates these terms or the law, you agree to defend us and cover any reasonable losses or expenses that result. The intent here is simple: we shouldn't have to pay for problems caused by how someone else used our site.

— Section 09

Termination

We can suspend or end your access to the site at any time, for any reason, especially if you're using it in a way that violates these terms. You're also free to stop using the site at any time. Sections that are meant to last beyond the end of your visit (like intellectual property and limitation of liability) keep applying.

— Section 10

Governing Law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any legal dispute connected to the site will be handled in the state or federal courts located in Georgia.

— Section 11

Changes to These Terms

We may update these terms from time to time. When we do, we'll update the date at the bottom of this page. Continuing to use the site after a change means you accept the new version.
